We will reimburse you for quantifiable monetary losses that occur through MyMerrillTM (our online retail brokerage platform) due to unauthorized third-party activity and subject to the conditions outlined below.
Merrill Lynch works hard to protect your information and the assets that you entrust to us. However, it is important for us to have a working partnership with you that enhances your online account security. In this regard, you must also take reasonable measures to protect against unauthorized online access, including:
- Frequently reviewing your online account information. If you detect any errors or discrepancies or suspect unauthorized activity in any account, to be eligible for our guarantee, you must contact us promptly, but not later than 60 days from the suspected unauthorized activity at 1.800.MERRILL (637.7455), or via your financial advisor. If you are a client of the Financial Advisory Center please call 1.888.ML INVEST (654.6837).
- Taking reasonable steps to safeguard your online access information, including Login ID, passwords and other access codes. If you share this information with anyone, we will consider their activities to have been authorized by you. Our guarantee will not apply if we determine that you shared this information, or if any unauthorized activity was caused by your fraudulent conduct or gross negligence.
- Learning the importance of Protecting Yourself by reviewing this guide which offers steps you can take to protect your information – in person, on the phone and online.

In addition to the above obligations, you agree to cooperate with us in any investigation and to take additional steps and corrective measures to protect against further fraudulent activity. We may ask you to sign an affidavit, assign certain rights to Merrill Lynch and/or sign a release form as a condition of reimbursement.
Merrill Lynch will determine the type and amount of reimbursement you will receive under this guarantee. We may not provide reimbursement under this guarantee if you are reimbursed, or if you are eligible for reimbursement, due to additional coverage by, for example, your insurance company, or protected under the terms of the particular product in question. This guarantee does not cover any tax consequences, legal fees and expenses, or lost opportunity, special, consequential or non-monetary damages. You may not assign your rights to any third-party other than Merrill Lynch under this guarantee.
